Montgomery County Sheriff’s Office - Eviction Procedures
 

1. Payment and Fees

  • All fees must be paid in advance using cash or money orders. No refunds will be given.
  • The eviction process is conducted Monday through Friday, beginning at 9:00 a.m.
  • Cost Breakdown:
    • Eviction Warrant: $105.00 (for one person)
    • Additional Persons Named in Warrant: $30.00 each
    • Mileage Fees: Two charges apply (one for serving the 14-Day Notice, one for attending the eviction).
    • You must provide the original warrant plus four copies per person listed on the warrant.
 

2. Eviction Notice & Scheduling

  • A 14-Day Notice will be served to the tenant(s) along with the warrant of eviction.
  • The Sheriff’s Civil Division will notify the landlord once service is completed and schedule the eviction.
 

3. Landlord Responsibilities

  • The Deputy must have access to the entrance door of the apartment. Notices cannot be tacked to a hallway or stairway door.
  • Do not disclose the date and time of the eviction to the tenant(s) for officer safety.
  • The landlord is responsible for:
    • Hiring movers and ensuring at least three workers (not counting the landlord) are present.
    • Arranging storage or disposal of tenant belongings (be aware of local codes regarding curbside disposal).
    • Handling vehicle removal/towing if necessary.
 

4. Day of Eviction

  • The landlord or a representative must be present and provide access to the premises (via key, locksmith, or force).
  • If the tenant moves out before the scheduled eviction, the deputy will still meet the landlord as planned to confirm the removal of any remaining belongings.
  • The landlord may change the locks once the eviction is completed.
 

5. Required Questionnaire for Landlords
